Resolutions of the Town Board, June 28, 2004
2004-263)
WHEREAS, a petition for the extension of Sewer District No. 1 in the Town of Schodack, County of Rensselaer, New York, was presented to the Town Board; and
WHEREAS, the petition and associated map, plan and report were filed in the office of the Town Clerk; and
WHEREAS, on June 10, 2004, the Town Board adopted an order that recited the filing of the petition, the proposed improvements, the boundaries and description of the proposed extension, the proposed method of financing, and the estimated costs of the improvements and all other matters required by law to be stated; and
WHEREAS, such order set June 28, 2004 at 7:00 p.m. at the Schodack Town Hall, 1777 Columbia Turnpike, Schodack, New York, as the time and place for a public hearing before all interested persons on the petition; and
WHEREAS, such order was posted and published as required by law; and
WHEREAS, the hearing on the petition was duly held on June 28, 2004, and all interested parties were heard;
NOW, IT IS HEREBY RESOLVED, that the Town Board designates itself as lead agency pursuant to the State Environmental Quality Review Act ("SEQRA"), determines that this action will have no adverse environmental impacts and issues a negative declaration determining that the project will not have a significant effect on the environment; and it is further
RESOLVED, that: (a) the petition is signed and acknowledged or proved as required by law, it complies with the requirements of the Town Law as to sufficiency of signers and is otherwise sufficient; (b) all the property and property owners within the proposed extension area are benefitted by the proposal; (c) all the property and property owners benefitted are included within the limits of the proposed extension area; (d) it is in the public interest to grant this relief sought in the petition; and it is further
RESOLVED, that the expansion of Sewer District No. 1 as proposed in the petition be approved; and the expansion shall be bounded and described as set forth in Schedule A, which is annexed hereto and made a part hereof; and
IT IS FURTHER RESOLVED AND ORDERED, that the Town Clerk shall cause copies of this Resolution and Order to be filed in accordance with applicable provisions of law.

WHEREAS, the Town of Schodack operates a Section 8 Housing Assistance Payments Program funded by the U.S. Department of Housing and Urban Development, and
WHEREAS, the Town of Schodack is required by the U.S. Department of Housing and Urban Development to prepare and adopt a written Annual Plan that establishes local policies for administration of the Section 8 Housing Assistance Payments Program in accordance with regulations of the U.S. Department of Housing and Urban Development, and
WHEREAS, the Town Board of the Town of Schodack has caused a written Annual Plan for 2004 to be prepared establishing local policies for administration of the Section 8 Housing Assistance Payments Program in accordance with regulations of the U.S. Department of Housing and Urban Development, and has reviewed such written plan,
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Schodack hereby adopts the Annual Plan for 2004 for operation of the Town of Schodack Section 8 Housing Assistance Payments Program.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Schodack does hereby authorize Supervisor Secor to execute a Letter of Intent with the Village of Castleton-on-Hudson to pursue good faith efforts to negotiate for a Schodack Landing sewer connection.

Authorize Jeffrey Conlin and Gary Ziegler, Building Inspectors to attend the FEMA NFIP Map Revisions Workshop, June 30, 2004 in Albany, New York with appropriate expense and cost of ($80) per member fee not to exceed ($160) to be borne by the Town.

WHEREAS, the Eastern Rensselaer County Solid Waste Management Authority (ERCSWMA) issued a joint bid with various Capital District communities for the purpose of obtaining a vendor for household hazardous waste collection days, one of which was to be conducted on September 25th, 2004 at the Village of Nassau Municipal Building; and
WHEREAS, an award was made to Care Environmental Corporation as the most economical and responsible bidder for the joint project; and
WHEREAS, the ERCSWMA has an approved site in place for the September 25th, 2004 collection day located at the Village Municipal Building, 40 Malden Street, Nassau, New York; further that the Village of Nassau does not object to the use of the Village site by residents of the Town of Schodack for the expresspurpose of participating in the household hazardous waste collection day; and
WHEREAS, an equitable division of fees has been established between the ERCSWMA and the Town of Schodack;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Town of Schodack agrees that it will be responsible for payment to the ERCSWMA for transportation and disposal of hazardous waste generated and delivered to the collection site on September 25th, 2004 by persons submitting accepted proof of residency in the Town of Schodack.
2. Payment is herein agreed upon to be the following: The Town of Schodack shall remit a $850 fee to the ERCSWMA for services provided pursuant to its participation in the collection day; the entire fee for any containers filled exclusively by generators from the Town of Schodack at the fees specified in the contract between Care Environmental and the ERCSWMA; a percentage (based on the quantity used by generators from the Town of Schodack, as agreed upon between the Town of Schodack and ERCSWMA representatives at the collection day) of the fees specified in the contract between Care Environmental and the ERCSWMA for hazardous waste containers filled by residents of the Town of Schodack and/or the Town of Schodack and/or the ERCSWMA; one half (50%) of the fees for transportation and disposal of non-hazardous wastes generated during the collection (cardboard and other debris); and one half (50%) of the fees for outreach and advertising.
3. The Town of Schodack Supervisor is herein authorized to remit to the ERCSWMA the sum necessary to pay its portion of the Care Environmental Services invoice within 30 business days after receipt of a properly completed voucher submitted by the ERCSWMA.

WHEREAS, a resolution was duly adopted by the Town Board of the Town of Schodack for a public hearing to be held by said Town on June 10, 2004 at 7:30 P.M. at the Schodack Town hall to hear all interested parties on proposed Local Law No. 2 of 2004 (P2-04), entitled "Active Military Duty Real Property tax relief" to reduce the rate of interest on unpaid real property taxes and assessments to zero percent (0%), which real property taxes and assessments have been levied against real property owned or occupied for dwelling agricultural or business purposes by a person in military service, or his/her dependents, who has been ordered to active military duty, other than training, for the period beginning with a declaration of war by Congress and ending with a date prescribed by Presidential proclamation or concurrent resolution of Congress and during any periods of combat designated by Presidential Executive Order of Hazardous Duty and
WHEREAS, notice of said public hearing was duly posted on the Town Clerk's Sign Board on May 25, 2004 and advertised in the May 28, 2004 editions of THE RECORD, the May 28, 2004 edition of THE ADVERTISER, official newspapers of the Town, and was posted on the official sign board of the Town on May 25, 2004 and
WHEREAS, said public hearing was held on June 10, 2004, at 7:30 P.M. at the Schodack Town Hall and all parties in attendance were permitted an opportunity to speak on behalf of, or in opposition to, said proposed local law and any part thereof, it is hereby
RESOLVED, that pursuant to part 617 of the implementing regulations pertaining to Article 8, State Environmental Quality Review Act, it has been determined by the Town that it is the lead agent and that adoption of said proposed Local Law would not have a significant adverse impact upon the environment and that it issues a Negative Declaration and,
WHEREAS, The Town Board of the Town of Schodack, after due deliberation finds that it is in the best interest of the Town to adopt said local law,
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Schodack hereby adopts Proposed Local Law No. 2 of 2004 (P2-04) entitled "Active Military Duty Real Property tax relief" to establish real property tax relief within the Town of Schodack and approvals by the Town of Schodack, New York and
BE IT FURTHER RESOLVED, That the Town Clerk, be and is hereby directed to enter said local law into the Code of the Town of Schodack and to give due notice of said local law to the Secretary of State.

WHEREAS, a petition for the extension of Water District No. 5 in the Town of Schodack, County of Rensselaer, New York, was presented to the Town Board; and
WHEREAS, the petition and associated map, plan and report were filed in the office of the Town Clerk; and
WHEREAS, on April 26, 2004, the Town Board adopted an order that recited the filing of the petition, the proposed improvements, the boundaries and description of the proposed extension, the proposed method of financing, and the estimated costs of the improvements and all other matters required by law to be stated; and
WHEREAS, such order set May 24, 2004, at 7:30 p.m. at the Schodack Town Hall, 1777 Columbia Turnpike, Schodack, New York, as the time and place for a public hearing before all interested persons on the petition; and
WHEREAS, such order was posted and published as required by law; and
WHEREAS, the hearing on the petition was duly held on May 24, 2004, and duly continued on June 10, 2004, and all interested parties were heard; and
WHEREAS, the Planning Board of the Town of Schodack, serving as lead agency pursuant to the State Environmental Quality Review Act ("SEQRA") for the environmental review of this project, including the actions covered by this resolution, issued a negative declaration, determining that the project would not have a significant effect on the environment.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, that: (a) the petition is signed and acknowledged or proved as required by law, it complies with the requirements of the Town Law as to sufficiency of signers and is otherwise sufficient; (b) all the property and property owners within the proposed extension are benefitted thereby; (c) all the property and property owners benefitted are included within the limits of the proposed extension; (d) the cost of the proposed improvements is to be assessed against the benefitted area and all real property to be so assessed will be benefitted by the proposed improvements and no benefitted property has been excluded; and (e) it is in the public interest to grant the relief sought in the petition and such will not constitute an undue burden on the property that will bear the cost thereof.
IT IS FURTHER RESOLVED AND ORDERED, that the extension of Water District No. 5 as proposed in the petition be approved, and that the extension shall bounded and described as set forth in Schedule A, which is annexed hereto and made a part hereof; and
IT IS FURTHER RESOLVED AND ORDERED, that the proposed improvements shall be financed as follows: The improvements requested by the petition are the connection to an existing Town water main to serve a proposed residential subdivision within the extension. The maximum amount to be expended for the improvements as stated in the petition is One Dollar ($1). The developer shall bear all costs of installation of new mains, which shall be conveyed to the Town at no cost; and
IT IS FURTHER RESOLVED AND ORDERED, that the Town Clerk shall cause copies of this Resolution and Order to be filed in accordance with applicable provisions of law.

Pursuant to the provisions of Town Law _ 150 (2), the Town of Schodack hereby establishes a Board of Police Commissioners effective immediately and appoints Councilman Kenneth W. Stinner, Councilman K. Michael Ziegler and Richard Sleasman as members of the Board of Police Commissioners for a term to expire on December 31, 2004. The Board of Police Commissioners shall serve as liaisons to the Police Department and shall serve without compensation. The Board of Police Commissioners may recommend policy for the consideration of the Town Board. The Town Board acknowledges the terms and conditions of the collective bargaining agreement with the Schodack Police Benevolent Association and does not seek to controvert its terms and conditions.

WHEREAS, WHEREAS, pursuant to the Laws of the State of New York 2003, Chapter 106, the State Legislature has passed the Patriot Plan, a municipal corporation to which real property tax is owed is authorized to extend the deadline for payment of real property taxes without penalties or interest by members of the deployed military upon adoption of a resolution; and
WHEREAS, WHEREAS, extending the deadline for payment of real property taxes on behalf of members of the deployed military will ease their burden in these difficult times.
NOW, THEREFORE, BE IT RESOLVED, the following be and the same hereby is adopted:
Section 1. Legislative Intent.
The Town Board of the Town of Schodack recognizes that the individuals who are members of the military make a tremendous sacrifice, especially in times like these when our military personnel are in many locations throughout the world and here in New York fighting against terrorism. This sacrifice is just as real for the men and women who comprise our reserve armed forces and state organized militia. For those who are not full-time active duty in the military, but instead are called to active duty as a member of the reserve armed forces or state organized militia, the rest of their lives must be put on hold to accommodate that service. However, such military personnel continue to be responsible for their own well-being, the well-being of their families and they must still face the obligations that exist in their everyday lives. Steps have been taken to ease some of the burdens that these brave men and women encounter, to allow them to focus their energy on defending our country; however, this Town Board recognizes that more must be done to ensure that military personnel engaged in active duty are not troubled by their obligations at home.
Section 2. Definition
A person deployed by the military is defined in Real Property Tax Law Section 925-d to mean a person who has been ordered to active military duty, other than training, for the period beginning with a declaration of war by Congress and ending with a date prescribed by Presidential proclamation or concurrent resolution of Congress or during any periods of combat designated by Presidential Executive Order or Hazardous Duty.
Section 3. Deployed Military; Extension
Relative to the collection of real property tax owed to the Town of Schodack or to the imposition of penalties or interest therefor for a late payment owed by a person who has been deployed by the military or by the spouse or domestic partner of such person for real property of a person so deployed, any deadline with respect to the payment of such real property tax shall be extended for a period of ninety (90) days after the end of such deployment.
Section 4. Escrow Accounts
Any payment on behalf of such deployed person, spouse or domestic partner from a real property tax escrow account shall likewise be so extended consistent with the provisions of this section.
Section 5. Effective Date
This resolution shall take effect upon adoption.
AND BE IT FURTHER RESOLVED, that a certified copy of this resolution shall be forwarded to the County Executive, the Office of the Comptroller, the Director of Veterans' Services, the County Real Property Tax Service Director, the County Treasurer and the Receiver of Taxes of the Town of Schodack.

WHEREAS, Stuart McKnight, has distinguished himself as a person of outstanding ability, establishing a high standard of integrity, and has imparted a sense of fairness, and compassion to the position of a Police Officer in the Town of Schodack, and
WHEREAS, Officer McKnight, has been a life-long resident of the Town of Schodack, graduated from Maple Hill High School in 1975, and then entered into the U.S. Army and receiving an honorable discharge in 1978, and
WHEREAS, Officer McKnight, was duly appointed as an Police Officer for the Town in May of 1980 and has served faithfully in that role until his retirement on December 31, 2003, and
WHEREAS, Officer McKnight was commended by the Town Board on October 9, 1986 for his investigation of a fatal accident and
WHEREAS, Officer McKnight was commended by New York State Police Troop T Commander Major James W. McMahon on December 9, 1986 for his quick response in searching for an escaped prisoner, which resulted in the successful apprehension of the escapee, and
WHEREAS, Stuart continued to serve in the U.S. Army Reserves until his retirement on March 7, 2004, and continues to demonstrate his commitment to the community by serving as Past Chief, life member of the Castleton Volunteer Fire Company, and
WHEREAS, Stuart has demonstrated his love of family, and
WHEREAS, Stuart's devotion to public service has also been recognized by actively serving as Battalion Deputy Fire Coordinator and his ongoing efforts with the COPS MORE,
NOW, THEREFORE, BE IT RESOLVED, that the Legislative Body of the Town of Schodack is moved to honor Stuart McKnight, who has given himself to this community in so many ways and distinguishing himself throughout his careers and as a longtime resident of this great Town, bringing great pride to his family, his peers, his associations and his community by being a person of commitment, integrity and an impressive role model for all, and be it

Hereby rescind Resolution 2004-060 and adopt the following to constitute Town Policy for Safe Backing [excerpts from New York State Commercial Driver's Manual] and Vehicle Accident Reporting [St. Paul Fire and Marine Insurance Company]:
As a result of limited visibility behind a vehicle, backing is always dangerous. Avoid backing whenever possible. Most importantly, avoid backing without a spotter when one is available. When parking, try to park to be able to pull forward when leaving. When a vehicle must be backed, here are a few simple safety rules to follow:
Look at the vehicle Path. Look at the line of travel before beginning to back. Check clearance to the vehicle's sides and overhead in and near the path the vehicle will take.
Sound Horn Before Backing. Sound your horn before backing to alert others.
Back Slowly. Always back as slow as possible. Use the lowest reverse gear in order to more easily correct any steering errors and stop quickly if necessary.
Back and Turn Toward Driver's Side. Back to the driver's side so as to see well. Backing toward the rider's side or blind side is very dangerous because this cannot be seen well, if at all. When backing back and turning toward the driver's side, a driver can watch the rear of your vehicle by looking out the side window. Use driver-side backing - even if it means going around the block to put the vehicle in this position. The added safety is worth it.
Use a Spotter. Except during snow and ice removal operations, a spotter must be used when one is available. There are blind spots a driver cannot see. That is why a spotter is important. Any available employee shall direct the driver of a backing vehicle, whether or not that employee is a passenger. The spotter should stand near the back of the vehicle where they can be visualized at all times. Stop at any time the driver loses sight of the spotter, and exit the vehicle to establish the spotter's location. If another employee is not available, the driver shall exit the vehicle before backing to check for clearance, perhaps more than once; and may have to walk completely around the vehicle to do so. Work out a set of hand signals both understand before beginning backing. Most importantly, agree on a signal for "stop."
Backing with a Trailer. When backing a car, straight truck, or bus, turn the top of the steering wheel toward the direction desired to go. When backing a trailer, turn the steering wheel in the opposite direction. Once the trailer starts to turn, turn the wheel the other way to follow the trailer.
To back with a trailer, try to position the vehicle to back in a straight line. If driver must back on a curved path, back to the driver's side to enhance visibility. Again, spotters must be used when available.
Back Slowly. This will allow the driver to make corrections before too far off course.
Use the Mirrors. The mirrors will allow the driver to see whether the trailer is drifting to one side or the other.
Correct drift immediately. As soon as the trailer is visualized getting off the proper path, correct it by turning the top of the steering wheel in the direction of the drift.
Pull forward. When backing a trailer, make pull-ups to re-position vehicle as needed.
Snow and Ice Removal Operations. Careful planning can minimize the need for backing during snow and ice operations. When backing is unavoidable and visibility is poor during actual snow and ice operations, the wing person is not required to exit the vehicle to spot the backing maneuver; nor is the operator, if alone, required to exit the truck before backing.
In such cases, the operator must use extreme caution, and back slowly and deliberately. Operators must make every reasonable effort to avoid backing, and are always fully responsible for the vehicle's safe operation.
The above rules constitute the Town of Schodack Backing Policy and are outlined in the New York State Commercial Drivers Manual. Backing without spotters should be avoided at all times. Spotters greatly decrease the likelihood of a backing incident or accident. Further, the likelihood of personnel injury or equipment loss will greatly be reduced through this policy.

WHEREAS, a sunset date for the LGRMIF was established in the original legislation to permit its operation as a five-year experiment, and
WHEREAS, the New York State Legislature in 1995 has twice extended the sunset date, most recently to December 31, 2005, and
WHEREAS, the LGRMIF has effectively supported essential advisory services and 6,300 grants totaling over $113 million to improve the management of records for over half of all NYS local governments, and
WHEREAS, the LGRMIF and the programs it supports continue to operate at a high standard of excellence and provide direct and significant benefit to local governments at no cost to the taxpayers, and
WHEREAS, the Town of Schodack has benefited from technical assistance, training, publications and five grants totaling approximately $137,837.00 supported by the LGRMIF, and

WHEREAS, SEAN, the son of Pamela and William Chester, is a senior at Columbia High School, a member of the Columbia Concert Band and Winds of Changes Blues Band, and has just recorded his third album;
WHEREAS, SEAN was also designated as the Columbia High School Student of the Month for his citizenship efforts and served as part of the Honor Guard for Governor George Pataki's inauguration on January 1, 2004;
WHEREAS, Sean placed a wreath at the Tomb of the Unknown Soldier to express his respect for the men and the ideals they fought and died for, as those ideals are instilled in every Scout;
WHEREAS, SEAN has been a volunteer at Four Doors Down, serves as an Assistant Sunday School Teacher, took third place in the Regional Science Olympiad and has participated in Junior Leadership training and will become a trainer to this Program;
WHEREAS, SEAN has earned 27 merit badges in his ten years of Boy Scouts, since starting as a Tiger Scout. Sean is a member of the Order of the Arrow and holds the position of Assistant Scout Master for Troop 522, as well as being the Troop's Assistant Chaplain;
WHEREAS, for his Eagle Project, SEAN designed, constructed and installed three reflection benches in the Schodack Town Park. Situated along the Moordnerkill, the stream that runs through the park, the benches are strategically placed so as to allow for the most advantageous and unimpaired view of the brook and surrounding vista to allow the community to enjoy a sense of peace and stillness;
NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Schodack commends and congratulates SEAN P. CHESTER upon his accomplishments in Scouting, and especially on his achievement of the rank of Eagle Scout, and be it further
